Terms of Service

What the Service provides

SmartName generates candidate names for your company, shop, brand or product, each with a short written description, using artificial intelligence (AI). The names are generated from the answers you give in our questionnaire. Results are shown on screen and sent to you by e-mail, usually within minutes. The number of names depends on the plan you choose.

Plans, prices and payment

1. The Service is sold as a one-time purchase. Current plans are: Light, USD 39 for 10 names; Standard, USD 79 for 25 names; Premium, USD 119 for 40 names. Current prices are shown on the Plans page. There is no subscription and no recurring charge.
2. Payment is due at the time of ordering.
3. Our order process is conducted by our online reseller Paddle.com. Paddle is the Merchant of Record for all our orders: Paddle processes your payment, calculates and collects any applicable sales tax or VAT, and issues your receipt. Paddle's own terms apply to the payment transaction.

Delivery and completion

Generation starts as soon as your payment and questionnaire are received. The Service is completed when your full set of names has been generated. We show the result on screen and also send you an e-mail with a link, so you can close the page and come back later. You can save the result as PDF or CSV. If you have a member account, past orders are also available on your My page.

Refunds and cancellation

1. The names are digital content generated on demand from your own answers. For that reason, once generation has started, orders cannot be cancelled and are not refundable, and you acknowledge that you lose any statutory right of withdrawal or cooling-off period, where such a right applies, once generation begins with your consent.
2. As an exception, if our system fails to generate or display your names, our system will retry automatically. If it still fails, we will either regenerate your names free of charge or refund the full amount you paid, at your choice.
3. Not liking the suggested names is not a reason for a refund.
4. Refunds are processed by Paddle as Merchant of Record and are returned to the original payment method. Full details are in our Refund Policy.

Your rights to the names, and what we do not guarantee

1. You may use any name we deliver freely, for any lawful purpose, with no additional fee and no need to credit us.
2. We do not perform trademark, company-register, domain or other availability searches. We do not guarantee that any name can be registered as a trademark, company name or domain, or that it does not conflict with the rights of others. Before adopting a name, please carry out your own searches or consult a professional. You are responsible for your choice.
3. Because names are generated by AI, other customers may receive the same or similar names. We do not grant exclusivity and we do not guarantee that a name is unique.
4. The descriptions, meanings and etymologies that accompany each name are written by AI. They are provided for inspiration and are not guaranteed to be accurate or complete. Please verify them before relying on them in any official or public material.

Member accounts (optional)

1. You can use the Service without an account. If you create one, please provide accurate information and keep your password confidential. You are responsible for activity under your account.
2. You may close your account at any time from My page ("Withdrawal"; your password will be confirmed). Closing your account deletes your account details and login and removes any entry you have in the Featured Gallery. Order records are kept as transaction records, but the link to your account is removed. If you want to keep your names, please save them as PDF before closing the account.

Acceptable use

You must not:

• register or order using false information;
• access the Service by automated means, or use it in bulk or at a scale beyond normal personal or business use;
• resell the generated names or descriptions to third parties as a naming service of your own;
• use the Service for any unlawful purpose or to infringe the rights of others;
• interfere with the operation or security of the Service;
• submit false content to the Featured Gallery or reviews, or attempt to manipulate our automated review (including by embedding instructions aimed at the AI).

We may suspend or refuse service if these rules are broken.

Featured Gallery and reviews

1. Featured Gallery. After you choose a name, you may apply, free of charge and entirely at your option, to have the name, your website URL and a short comment shown in our Featured Gallery. Applications are checked automatically (by AI) and published if they meet our guidelines; unclear cases are held for manual review. By applying, you agree that we may fetch your website to check it. You can remove your entry at any time from My page or the decision page, and it is removed automatically if you close your account. We may decline or remove any entry at our discretion, for example content that is defamatory, adult, gambling-related or unlawful.
2. Reviews. If you choose to leave a review, we may display it, after approval, together with the display name you provide (or "Customer" if you leave it blank), your plan and the month of use, on our Plans page and elsewhere on the site. To have a review taken down, contact us at the address below.

Limitation of liability

1. We do not guarantee any business outcome from using a name we suggest.
2. To the fullest extent permitted by law, our total liability to you for any claim arising out of or relating to the Service is limited to the amount you actually paid us for the order concerned.
3. We are not liable for loss caused by events outside our reasonable control, such as network failures or outages at our payment or AI providers.
4. Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, including liability for death or personal injury caused by negligence, for fraud, or your non-excludable rights under consumer law.

Changes to the Service

We may change, suspend or discontinue the Service. If you have paid for an order that has not yet been delivered, we will either deliver it or refund you.

Changes to these Terms

We may update these Terms when the law or the Service changes. We will post the new version on this page with a new effective date and, for important changes, announce them on the site. Orders are governed by the Terms in force at the time of ordering.

Governing law

These terms are governed by the laws of the United Arab Emirates, without regard to conflict-of-law rules; nothing in these terms limits rights you have under mandatory consumer law where you live. If a dispute arises, we will first try to resolve it with you in good faith.
